1. Who we are
KeepKase is a thin, Apple-aligned MacBook hardshell case with a removable expression layer — a hardshell border that holds two clear sheets, which sandwich your stickers and flat memory items. No adhesive ever touches the laptop. Swap layouts anytime, and retire a sheet as a keepsake.
These Terms of Service ("Terms") are an agreement between you and [LEGAL_ENTITY] ("KeepKase," "we," "us," or "our"). They cover your use of our storefront, the products you order, the waitlist, and our community spaces.
By placing an order, joining the waitlist, or participating in our community, you agree to these Terms. If you do not agree, please don't use the store or the program.
2. This is an Alpha product
KeepKase is currently in a 100-person Alpha. That word matters, so here is what it means in practice:
- Prototype stage. The product is being designed and built in the open. Prototyping is currently 3D-printed, and materials are still being explored. Specifics — including materials, dimensions, colorways, and finishes — are in flux and may change.
- Sold at cost. The Alpha price is not a markup. You are helping fund and shape the build.
- It will evolve. Designs, features, and timelines may change as we learn. We share decisions with the community and, where it makes sense, put them to a vote.
- It may have imperfections. An Alpha unit is not a finished retail product. Expect rough edges and the occasional flaw.
- Feedback is part of the deal. Alpha members are expected to give honest feedback and report issues. That participation is the point.
Nothing here is a promise of a specific final product, specification, certification, or ship date. Where a date or window is referenced, treat it as a target, not a guarantee. Estimated shipping: [SHIP_WINDOW].
3. Orders, pricing, and payment
- Alpha unit price: $50, sold at cost. There are 100 total Alpha spots.
- Alpha perks (as described at the time you join) include: a unit at cost; 35–40% off the planned Kickstarter launch price; your name in the product credits; direct Discord access with the team; and first pick of colorways.
- Payment is processed through Shopify and its payment providers. By ordering, you also agree to the applicable Shopify terms that govern checkout. We do not store full card details ourselves.
- Pricing and availability can change. We do our best to keep listings accurate, but if an obvious error occurs (for example, a clear pricing mistake), we may cancel the affected order and refund you.
- Taxes, duties, and shipping may apply depending on your location and will be shown or noted where applicable.
- Order changes and cancellations. Because this is a small-batch Alpha, please contact us as early as possible at [SUPPORT_EMAIL] if you need to change or cancel. We'll do our best, depending on where the build stands.
Future mainstream pricing (a lower modular base price with discounted multi-packs of clear sheets) is a plan, not an offer under these Terms. The Alpha is $50 at cost.
4. Launch Waitlist and the refundable deposit
Separate from the Alpha, we offer a free Launch Waitlist:
- Joining is free. It holds a warm spot and keeps you in the loop for the planned Kickstarter launch.
- Optional $10 deposit. You can place an optional $10 deposit to move toward the front of the line at launch.
- The deposit is refundable. You may request a refund of the $10 deposit at any time before it is applied to a purchase, and we will return it. The deposit is a placeholder for priority — not a charge for a product and not a guarantee that any specific product, price, or date will be available.
- No obligation. Being on the waitlist, with or without a deposit, does not obligate you to buy anything.
To request a deposit refund or leave the waitlist, contact [SUPPORT_EMAIL].
5. Intellectual property
- Our materials. The KeepKase name, logo, site design, product designs, text, and graphics are owned by us or our licensors and protected by applicable law. We grant you a limited, personal, non-transferable license to use the store and community for their intended purpose. Please don't copy, resell, or pass off our materials as your own.
- Your content. You keep ownership of the content you create and post (see Section 6). You grant us a non-exclusive, worldwide, royalty-free license to display and use that content to run and promote the program and community. You can ask us to stop using specific content by contacting us.
- Your own stickers and items. What you put inside your sheets is yours and your responsibility. Don't use the product to infringe anyone else's rights.
6. Community content and Discord conduct
A Discord server is the home of the Alpha. Members give feedback, watch the build in the open, and help shape decisions. A few ground rules:
- Be decent. No harassment, hate, threats, doxxing, or spam. Treat people the way you'd want a small community to treat you.
- Keep it lawful. Don't post illegal content, malware, or content that infringes someone else's rights.
- Feedback is welcome and expected — including the critical kind. Honest, good-faith input is the whole idea.
- You're responsible for what you post. What you share reflects you, not us. We may remove content or restrict access that breaks these rules or Discord's own terms.
- No confidential leaks. If something is shared with the community as work-in-progress or in confidence, please respect that.
We may moderate, remove content, or remove members to keep the community healthy. We'll aim to be fair and proportionate.
7. Disclaimers
Because this is an Alpha:
- The store, the community, and the product are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent allowed by law. This includes implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We don't promise the product will be error-free, meet every expectation, or remain unchanged.
- The product is thin hardshell — parity protection, not rugged or maximum protection. Don't rely on it as drop-proof or as a substitute for careful handling, backups, or insurance for your device.
- Nothing here removes any rights you have under mandatory consumer-protection laws in your jurisdiction that cannot be waived.
8. Limitation of liability
To the fullest extent permitted by law, and appropriate to an at-cost Alpha program:
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or damage to your device or its finish arising from your use of the product, store, or community.
- Our total liability for any claim relating to these Terms or the Alpha is limited to the amount you actually paid us for the item the claim relates to.
- Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you. Where that's the case, our liability is limited to the smallest extent the law allows.
9. Changes to these Terms
We may update these Terms as the Alpha evolves. When we make material changes, we'll update the date above and, where practical, share a note in the community. Continuing to use the store or community after an update means you accept the revised Terms.
10. Governing law
These Terms are governed by the laws of [JURISDICTION], without regard to its conflict-of-laws rules. Any dispute will be handled in the courts located in [JURISDICTION], unless mandatory local law gives you the right to a different venue.
